Terms of Service

These Terms of Service ("Terms") govern your access to and use of TalkWP (the "Service"), operated by TalkWP ("we", "us"). By creating an account or using the Service, you agree to these Terms.

1. The Service

TalkWP provides an AI-powered live chat widget that businesses can embed on their websites, along with a dashboard for managing conversations, customizing the widget, and viewing analytics.

2. Accounts

You must provide accurate information when creating an account and are responsible for maintaining the confidentiality of your login credentials. You are responsible for all activity that occurs under your account.

3. Plans, Pricing & Billing

• TalkWP offers a Free plan and paid subscription plans (Pro, Business), billed monthly.
• Paid plans are billed in advance and processed via Razorpay or PayPal.
• Prices are listed in INR (Razorpay) or USD (PayPal) and may change with notice posted on this page or communicated by email.
• Subscriptions renew automatically each billing cycle unless cancelled before the renewal date.

4. Cancellations

You may cancel or downgrade your plan at any time from the Billing tab in your dashboard. Cancellation takes effect at the end of the current billing period unless otherwise stated. See our Refund Policy for details on refunds.

5. Acceptable Use

You agree not to use the Service to transmit unlawful, abusive, harassing, or infringing content, to attempt to disrupt or gain unauthorized access to the Service, or to resell the Service without our written permission.

6. Your Content & Data

You retain ownership of the content and data you submit through the Service (including chat transcripts and widget configuration). You grant TalkWP a limited license to process this data solely to provide and improve the Service. See our Privacy Policy for how we handle personal data.

7. Third-Party Services

The Service relies on third-party providers, including Groq (AI responses), Supabase (data storage), Razorpay and PayPal (payment processing). Your use of the Service is also subject to those providers' own terms where applicable.

8. Service Availability

We aim for high availability but do not guarantee the Service will be uninterrupted or error-free. We may modify, suspend, or discontinue features with reasonable notice where practical.

9. Limitation of Liability

To the maximum extent permitted by law, TalkWP shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the three (3) months preceding the claim.

10. Termination

We may suspend or terminate your account for violation of these Terms. You may stop using the Service and delete your account at any time by contacting support.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of India, without regard to conflict-of-law principles.
